Terms and Conditions

1. About these Terms
These Website Terms and Conditions (Terms) govern your access to practicesuccess.org and related pages, portals, events, masterclasses, memberships, communities, digital resources and services provided by Practice Success Collective Pty Ltd (ABN 72 166 023 721) (Practice Success, we, us or our).

By accessing the website, creating an account, registering for an activity or using a service, you agree to these Terms. If you do not agree, you must not use the relevant service.

Additional written terms, event details or membership descriptions may apply to a particular offering. If there is a direct inconsistency, the specific terms for that offering apply to the extent of the inconsistency.

Our Privacy Policy explains how we collect, use, store and disclose personal information.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering into a contract.

If you use a service on behalf of an organisation, you confirm that you have the authority to bind that organisation. References to you include that organisation where appropriate.

You must provide accurate, current information and keep it updated.

3. Accounts and access

You are responsible for keeping your account credentials confidential and for activity conducted through your account.

You must not share access unless the relevant offering expressly allows it. Please notify us promptly if you suspect unauthorised access or use.

We may require reasonable identity or authority checks and may temporarily suspend access while investigating security or misuse concerns.

4. Registrations and participation

A registration is not confirmed until we issue confirmation or grant access to the relevant event, program or service.

Registrations may be subject to availability, eligibility requirements or participation limits.

We may decline or cancel a registration where reasonably necessary because of capacity, safety, security, misuse, inaccurate information or another legitimate operational concern.

Unless stated otherwise, registrations are for the named participant and may be transferred only with our approval.

5. Events, masterclasses and recordings

Event dates, speakers, venues, formats, content and availability may change because of illness, technology failure, venue issues, safety concerns, demand or circumstances outside our reasonable control.

We may substitute a speaker or session, reschedule an event, move an event online or cancel it. If we make a material change, we will notify registered participants and provide a reasonable alternative where appropriate.

You must comply with all reasonable venue, safety, platform and conduct requirements.

We may record online or in-person sessions. We will provide notice where participants may be identifiable and seek consent where required.

You must not record, copy or redistribute a session without our permission.

Any continuing professional development hours or recognition are subject to the stated eligibility, attendance and completion requirements and the rules of the relevant professional body. You are responsible for confirming that an activity meets your professional requirements.

6. Educational information, not professional advice

Our content provides general educational and business information. It is not medical, clinical, legal, employment, property or other professional advice and is not a substitute for advice tailored to your circumstances.

We do not provide patient care through the website.

You remain responsible for your decisions, regulatory obligations, professional standards and independent assessment of any information, template, strategy or recommendation.

Examples, forecasts, case studies, opinions and results are illustrative and do not guarantee any particular outcome, growth, accreditation, patient result or business performance.

7. Independent experts and third parties

Speakers, panellists, sponsors, advisers, expert partners and other third parties are independent unless we expressly state otherwise.

Their views are their own. Their inclusion, an introduction or a link does not represent a guarantee that a third party or its services will be suitable for you.

Any engagement with a third party is a separate relationship between you and that party and is subject to its own terms and privacy practices.

You should conduct your own due diligence and obtain appropriate advice before engaging a third party.

8. Community standards and confidentiality

When participating in a Circle, member portal, webinar chat, event or community space, you must act professionally, respectfully and lawfully.

You must not:

- Post unlawful, defamatory, discriminatory, harassing, deceptive, infringing or harmful material.

- Share patient information, confidential practice information or another person’s personal information without proper authority.

- Send unsolicited promotions, scrape member details or harvest contact information.

- Impersonate another person or misrepresent your credentials, identity or affiliations.

- Copy, record, disclose or exploit another participant’s confidential contribution without permission.

- Disrupt a service, introduce malware, bypass access controls or use automated extraction tools without written permission.

- Use the community in a way that compromises its purpose, safety or integrity.

Participants may be asked to respect confidentiality, but we cannot guarantee that every participant will do so. You should exercise care when sharing information.

We may moderate or remove content and restrict or terminate access where conduct breaches these Terms or creates a material risk.

9. Intellectual property

We and our licensors own all intellectual property rights in the website and our materials, including text, videos, recordings, graphics, branding, frameworks, templates and course content.

We grant you a limited, revocable, non-exclusive and non-transferable licence to access materials provided to you for your own internal professional or business learning purposes during the applicable access period.

Unless permitted by law or authorised by us in writing, you must not:

- Reproduce or republish our materials.

- Sublicense or distribute our materials.

- Publicly display our materials.

- Create derivative products from our materials.

- Use our materials to train an artificial intelligence model.

- Use our materials to create or support a competing service.

Practice Success names, logos and marks must not be used without our permission.

10. Your content and feedback

You retain ownership of content you submit.

You grant us a worldwide, non-exclusive licence to host, reproduce, format and communicate that content where reasonably necessary to operate, promote and improve the service through which it was submitted.

For testimonials, photographs or identifiable promotional content, we will rely on the permission you provide and any stated limitations.

You confirm that you have the rights and permissions required for any content you submit.

If you provide suggestions or non-confidential feedback, we may use that feedback to improve our services. We will not identify you publicly without permission.

11. Availability and acceptable use

We aim to keep our services available but do not guarantee uninterrupted access.

Maintenance, outages, third-party systems and circumstances outside our reasonable control may affect availability.

You must use the website and services only for lawful purposes and in accordance with these Terms.

You must not:

- Probe, attack or interfere with the website or services.

- Attempt to gain unauthorised access.

- Reverse engineer any part of the service.

- Unreasonably burden our infrastructure.

- Infringe another person’s rights.

- Use the website or services for unlawful, deceptive or harmful purposes.

12. Consumer rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or another law that cannot lawfully be excluded.

To the extent of any inconsistency, applicable non-excludable rights will prevail.

13. Disclaimers and liability

To the maximum extent permitted by law, we do not warrant that content will always be complete, current, accurate or suitable for a particular purpose.

We do not guarantee that services will always be available or uninterrupted.

We are not responsible for independent third-party advice, services, websites, content or conduct.

To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss, except where such a limitation would be unlawful.

Where the law permits us to limit a statutory guarantee relating to services, our liability may be limited to providing the services again or another remedy permitted by law.

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

14. Indemnity

To the extent permitted by law, you indemnify us against third-party claims and losses arising directly from:

- Your unlawful use of a service.

- Your material breach of these Terms.

- Content you submit that infringes another person’s rights.

This indemnity is reduced to the extent that our act or omission caused or contributed to the relevant claim or loss. It does not apply where it would be unfair or unlawful.

15. Suspension and termination

You may stop using our services or request the closure of your account or membership at any time.

We may suspend or terminate access where you:

- Materially breach these Terms.

- Misuse a service.

- Compromise another person’s rights.

- Create a material safety, legal or security risk.

- Engage in serious or repeated misconduct.

Where reasonable, we will provide notice and an opportunity to address the issue. We may take immediate action where serious misconduct or urgent risk is involved.

Termination does not affect rights that arose before termination.

Provisions intended by their nature to continue—including intellectual property, confidentiality, disclaimers, liability and dispute provisions—will survive termination.

16. Changes to services and these Terms

We may update our services and these Terms from time to time.

The current Terms will be published on our website with their effective date. Changes will not retrospectively remove rights that have already arisen.

Where a material change affects an existing service or membership, we will provide reasonable notice where appropriate.

Continued use after the effective date of an update constitutes acceptance only to the extent permitted by law.

17. General

These Terms and any applicable specific terms form the agreement between you and us concerning the relevant service.

If a provision is invalid or unenforceable, it will be severed to the minimum extent necessary and the remainder will continue to apply.

A failure to enforce a right is not a waiver of that right.

You may not assign your rights under these Terms without our consent. We may assign our rights as part of a genuine organisational restructure, provided this does not reduce your non-excludable rights.

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

Before commencing proceedings, each party should attempt in good faith to resolve the dispute through written notice and discussion, except where urgent relief is required.
